1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the KidSpark Academy iOS application ("the App"), operated by KidSpark Academy ("we," "us," "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
If a user is under 13, a parent or legal guardian must read and accept these Terms on their behalf. The parent/guardian is responsible for supervising the child's use of the App.
2. License Grant
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, solely for your personal, non-commercial educational use.
You may not: reverse engineer, decompile, or disassemble the App; modify or create derivative works based on the App; redistribute, sell, rent, lease, or sublicense the App; remove any proprietary notices or labels; or use the App for any unlawful purpose.
3. Subscriptions (Pro)
3.1 What Pro unlocks
A KidSpark Academy Pro subscription unlocks Intermediate and Advanced lesson tiers across every language, plus streak freezes and other perks described in-app.
3.2 Billing, length, and auto-renewal
- Monthly plan: billed every month at the price shown in the App at the time of purchase.
- Annual plan: billed every year at the price shown in the App at the time of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew for the same period unless you cancel at least 24 hours before the end of the current period.
- Your Apple ID will be charged for the renewal within 24 hours prior to the end of the current period.
3.3 Managing and cancelling
You can manage, pause, or cancel your subscription at any time in Settings > Apple ID > Subscriptions on your device. Cancelling stops the auto-renewal; you retain access until the end of the current paid period.
3.4 Refunds
Refunds are handled by Apple according to the App Store Terms and Conditions. KidSpark Academy cannot issue refunds directly. To request a refund, visit reportaproblem.apple.com.
3.5 Price changes
If we change the subscription price, we will notify you through the App and/or Apple's standard price-change flow before the change takes effect. If you do not agree to the new price, you may cancel before the next renewal.
4. Acceptable Use
You agree not to:
- Use the App in a way that violates any law or regulation.
- Attempt to gain unauthorized access to any part of the App or its systems.
- Interfere with or disrupt the App's operation or security.
- Use the App to harass, defame, or harm others.
5. Parent and Guardian Responsibility
The App is designed for children and teens. If the user is under 13, a parent or legal guardian:
- Must review and accept these Terms and our Privacy Policy on the child's behalf.
- Is responsible for the child's use of the App and any purchases made through the child's Apple ID.
- Acknowledges that the App collects no personal data from the child, as described in the Privacy Policy.
6. Educational Content — Disclaimer
Lesson content is provided "as is" for educational purposes. We make no guarantee that the App will make any user proficient in any programming language, pass any certification, or achieve any specific educational outcome.
7. Intellectual Property
All content in the App — including lessons, code samples, logos, graphics, and the "KidSpark Academy" name — is owned by KidSpark Academy or its licensors and is protected by copyright and trademark law. No ownership is transferred to you by these Terms.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDSPARK ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
10. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access if you violate these Terms. Upon termination, your license to use the App ends; provisions that by their nature should survive (ownership, disclaimers, limitation of liability) will survive.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be highlighted in the App or on this page with an updated "Effective" date. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising under these Terms will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer-protection rights you have under the laws of your country of residence.
13. Apple-Specific Terms
- These Terms are between you and KidSpark Academy, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide support or maintenance for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; beyond that, Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
